Difference Between Cognizable and Non-Cognizable Offences in India

Cognizable offences are those offences in which the police doesn’t need a court warrant to arrest or initiate an investigation. These are generally serious offences like rape, murder, kidnapping, theft, robbery etc. The cognizable crimes generally carry stentences more than 3 years or life imprisonment or even death penalty.

Non-cognizable offences are those offences in which the police cannot make arrest or initiate an investigation without getting warrant from the court. These offences are generally less serious offences which bear sentence less than 3 years. These are offences like forgery, assualt, cheating, defamation etc.

Cognizable Offence

A cognizable offence comes under Section 2(g) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023. These are serious offences and are a threat to the society at large and that’s the reason, police need to take swift action in these mattres. Therefore the police are given a head start in such situation so that they can take prompt action.

Non-Cognizable Offence

A non-cognizable offence comes under Section 2(o) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023. These are those offences in which the police cannot make an arrest without court orders. Not only that , the police cannot even start an investigation without court order.

These offences are of less serious nature and generally carry sentences less than 3 years. Offences like cheating, forgery, defamation, assault etc. come under the non-cognizable offences. The primary obeject is to protect the legal rights of individuals against unwarranted detention and abuse of power by the police.
